These Terms of Service ("Terms") govern the use of the website and services provided by 360 Spaces, a business operating in Cape Town, South Africa, offering Matterport services, including 3D tours, floor plans (3D and 2D), dollhouse views, 3D renderings, and online real estate marketing. By accessing or using our website (the "Site") and booking our services, you ("Customer") agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

1. **Services Provided**

360 Spaces offers the following services:

- 3D Virtual Tours

- 2D & 3D Floor Plans

- Dollhouse Views

- 3D Renderings of physical spaces

- Online Real Estate Marketing services

We may update or modify the services provided from time to time at our discretion. Details of available services can be found on our website.

2. **Booking and Payment**

- **Booking Process**: Customers can book services directly through our website by completing the booking form. Alternatively, customers may request a quote for custom services.

- **Pricing**: Prices for services are listed on the website and may vary based on the type and scope of the service requested. Prices are subject to change without notice.

- **Payment**: Payment is required upon booking or before service delivery, depending on the terms outlined during the booking process. We accept payments through electronic invoicing accepted by all major South African financial institutions.

- **Deposits**: Some services may require a non-refundable deposit. The deposit amount and payment terms will be outlined at the time of booking.

- **Cancellations and Rescheduling**: Customers may cancel or reschedule services with at least 48 hours notice. Cancellations made less than 48 hours before the service date may incur a 600R cancellation fee.

3. **Customer Responsibilities**

- **Access to Property**: The customer is responsible for providing the necessary access to the property where services will be provided. This includes ensuring that all areas to be photographed or rendered are accessible and free from obstructions.

- **Preparation of Space**: The customer should ensure that the space is in a presentable condition for the services to be performed. Failure to do so may result in delays or additional fees.

- **Accuracy of Information**: The customer agrees to provide accurate and truthful information during the booking process, including details about the property and any special requirements.

4. **Intellectual Property Rights**

- **Ownership of Content**: All content produced by 360 Spaces, including 3D tours, floor plans, renderings, and other visual media, remains the intellectual property of 360 Spaces unless otherwise agreed in writing.

- **License to Use**: Upon payment for services, the customer is granted a non-exclusive, non-transferable license to use the produced content for the purposes specified in the booking agreement (e.g., marketing the property online or offline). The customer may not alter, resell, or use the content for any purpose not agreed upon in the contract.

- **Third-Party Use**: The customer may not grant third parties access to or use of the content without prior written consent from 360 Spaces.

5. **Privacy and Data Protection**

- **Data Collection**: In the course of providing services, we collect personal data, including contact information, payment details, and property information. We respect your privacy and handle all data in compliance with South Africa's Protection of Personal Information Act (POPIA).

- **Use of Data**: The data collected will be used solely for the purposes of service delivery, billing, and customer support. We will not share your data with third parties unless required by law or as necessary to fulfill our obligations.

- **Security**: We employ reasonable measures to protect the security of your personal data. However, no data transmission over the internet is completely secure, and we cannot guarantee the absolute security of your information.

6. **Website Use**

- **User Responsibilities**: By accessing the website, you agree not to:

- **Force Majeure**: We are not responsible for any delays or failures to perform our obligations if such delays or failures are due to circumstances beyond our control, including but not limited to natural disasters, strikes, technical failures, or government restrictions.

8. **Amendments to the Terms**

360 Spaces reserves the right to modify or update these Terms at any time. Any changes will be posted on this page, and the "Effective Date" will be updated accordingly. By continuing to use our services after the changes are posted, you agree to the revised Terms.

We may suspend or terminate access to our services if we believe a customer has violated these Terms or engaged in unlawful activity. Upon termination, the customer agrees to cease using our services and may be subject to applicable penalties or fees.
